California state law requires all cities, counties, and the state itself, as well as other public entities that maintain roads, to keep our roadways safe. The underlying philosophy of this law is that if the public entities are held responsible for dangerous conditions of roadways, they will act to keep the roadways safe and thereby minimize serious injuries or deaths.

California highway design attorneys’ experience is that this approach to highway design defects has been very effective. When an accident occurs as a result of a dangerous condition of a roadway, and a claim is filed, the dangerous roadway condition, not only at the site of the accident, but similar conditions in other jurisdictions are corrected so as to prevent similar accidents in the future.

The plaintiff’s citizenship or immigration status is not an issue in cases involving unsafe highway design or failure in highway maintenance. Casey Gerry has represented Mexican citizens, Mexican nationals living in the US, and undocumented immigrants who have been harmed by unsafe highway design. If the harm was due to unsafe or defective highway design or maintenance, Casey Gerry attorneys can pursue redress in US courts.

At the time of a serious motor vehicle accident or other injury on a public roadway, the parties involved may not be aware that faulty highway design contributed to their accident. The influence of faulty design, construction, or maintenance may become clear in the course of investigation of the accident. For a thorough understanding of what occurred and of all the contributing factors, an investigation should take place soon after the events, while evidence is available and witnesses’ memories are fresh.

After a roadway accident involving pedestrians, bicyclists, or any kind of motor vehicle, it is prudent to contact an attorney experienced not only in motor vehicle law in California but also in California highway design law who can be alert to the possibility of defects in roadway design, construction and maintenance as possible contributors to the accident.

If you believe that highway design defects contributed to your injuries or your loved one’s injuries or death you should contact an attorney immediately for review of a potential claim. There are deadlines set by laws which regulate the filing of lawsuits, called statutes of limitation. These vary state by state. If the statute of limitations expires, your right to pursue a claim against the entity may be forever barred.
